Welcome to Higher Standards Lifestyle ("we," "us," or "our"). By downloading, installing, or using our mobile application ("App") and services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Service.

1. Acceptance of Terms

By creating an account or otherwise using the app, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

The app is intended for users who are at least 18 years old or the legal age of majority in your jurisdiction. If you are under 18, you must have the permission of a parent or guardian to use the Service.

You should consult a physician or other qualified healthcare provider before starting any fitness program or if you have any medical conditions or concerns.

By using the app, you acknowledge and agree that you are solely responsible for your health and fitness decisions, and we are not liable for any injuries, losses, or damages resulting from your use of the app.

5. User-Generated Content

The Service may allow you to submit, post, or share content, including workout routines, progress updates, comments, or other materials ("User Content"). You retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free, and transferable license to use, reproduce, modify, and display your User Content for the purposes of operating and promoting the Service.

You agree that your User Content will not:

• Violate any third-party rights, including intellectual property rights
• Contain offensive, defamatory, or inappropriate material
• Misrepresent your identity or affiliation
• Promote illegal activities or harmful content

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable in our sole discretion.

6. Fees and Subscriptions

Certain features of the app may require payment of fees or a subscription. By subscribing to a paid plan, you agree to pay all applicable fees. Subscription fees are billed in advance on a monthly or annual basis, depending on the plan you select.

The app and all materials contained within it, including but not limited to text, graphics, logos, videos, and software, are the property of Higher Standards Lifestyle or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, and non-transferable license to access and use the app for personal, non-commercial purposes. You may not copy, distribute, modify, or create derivative works based on the app without our express written permission.

8. Termination

We reserve the right to suspend or terminate your access to the app at any time, without notice, for any reason, including but not limited to a breach of these Terms.

Upon termination, all licenses and rights granted to you in these Terms will immediately cease, and you must discontinue all use of the app.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Higher Standards Lifestyle shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or use, arising out of or in connection with the app or these Terms.

Our total liability for any claims related to the Service is limited to the amount you paid, if any, for the use of the Service.

10. Indemnification

You agree to indemnify and hold harmless Higher Standards Lifestyle, its affiliates, and its employees from any claims, damages, or losses arising out of your use of the app, violation of these Terms, or infringement of any rights of a third party.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Effective Date." Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions.
